1. Acceptance of Terms

By accessing or using earthbetz.org (hereinafter referred to as "the Platform," "we," "us," or "our"), you agree to be bound by these Terms and Rules (the "Terms"). If you do not agree to all of these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and earthbetz.org.

We reserve the right to modify, amend, or update these Terms at any time without prior notice. Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for any changes. 2. Eligibility and Account Registration

To use our Platform, you must meet the following eligibility requirements. By registering an account or using our services, you represent and warrant that:

• You are at least 18 years old or the legal gambling age in your jurisdiction, whichever is higher. We reserve the right to request proof of age at any time and suspend accounts that cannot verify age requirements.

• You are registering on your own behalf. You may not create an account for another person or use another person's identity or payment methods without explicit authorization.
• You have not been previously suspended or banned from our Platform or any related services for violations of our Terms.
• You are not a professional gambler using automated systems, bots, or software to gain unfair advantages.
• You are not an employee, contractor, or affiliate of earthbetz.org unless explicitly permitted in writing.

When registering an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to protect your account information.

Each individual may register only ONE account. Creating multiple accounts (including "bonus hunting" accounts) is strictly prohibited and will result in immediate termination of all associated accounts, forfeiture of all funds, and a permanent ban from our Platform.

3. Prohibited Activities

The following activities are strictly prohibited on our Platform. Violation of any of these rules may result in immediate account suspension, forfeiture of funds, permanent ban, and legal action where applicable:

3.1 Fraud and Cheating

• Using automated software, bots, scripts, or "cheat engines" to interact with our Platform. All gameplay must be manually performed by the registered user.
• Collusion with other players to manipulate game outcomes, share cards, or gain unfair advantages in multiplayer games.
• Exploiting bugs, glitches, or vulnerabilities in our software. If you discover a technical issue, you must report it to us immediately rather than exploiting it for personal gain.
• Abusing bonus offers by creating multiple accounts, using VPNs to claim geo-restricted bonuses, or employing strategies designed solely to clear bonus requirements without genuine play.
• Chargeback fraud or disputing legitimate transactions with payment processors after receiving winnings.
• Using stolen payment methods, identity theft, or fraudulent documents for KYC verification.

3.2 Technical Misconduct

• Using VPNs, proxies, or anonymizing services to mask your true location or circumvent geographic restrictions. Your IP address must accurately reflect your physical location at all times.
• Attempting to hack, crack, reverse-engineer, or decompile our software, website code, or security systems.
• Launching denial-of-service (DDoS) attacks, flooding, or any form of cyberattack against our infrastructure.
• Uploading malware, viruses, ransomware, or malicious code through any interaction with our Platform.
• Scraping, crawling, or data mining our website content without explicit written permission.

3.3 Account Misconduct

• Creating multiple accounts for any reason, including to claim multiple welcome bonuses or circumvent self-exclusion.
• Buying, selling, trading, or transferring accounts to other individuals.
• Sharing account credentials with third parties or allowing others to access your account.
• Providing false information during registration or KYC verification including fake names, addresses, or identification documents.
• Using a "proxy gambler" who places bets on your behalf to circumvent self-exclusion or account restrictions.

3.4 Financial Misconduct

• Money laundering, terrorist financing, or any financial crime using our Platform as a vehicle.
• Structuring deposits or withdrawals to avoid reporting thresholds or anti-money laundering monitoring.
• Using our Platform for currency exchange or arbitrage rather than genuine gambling activity.
• Depositing funds from illegal sources including proceeds from drug trafficking, fraud, theft, or organized crime.
• Processing payments on behalf of third parties or acting as an intermediary for others' gambling transactions.

3.5 Behavioral Misconduct

• Harassing, threatening, or abusing other players, our support staff, or any employees of earthbetz.org.
• Using hate speech, discriminatory language, or offensive content in chat features, forums, or any communication channel.
• Spamming, flooding, or excessive messaging in chat rooms or to support channels.
• Posting links to competing gambling sites, referral codes, or advertising on our Platform.
• Attempting to circumvent responsible gambling tools including deposit limits, session limits, or self-exclusion.

4. Deposits and Withdrawals

All financial transactions on our Platform are subject to the following terms and conditions:

4.1 Deposits

• Minimum deposit: The minimum deposit amount is $10 USD or equivalent in your local currency. We reserve the right to change minimum deposit requirements at any time.
• Payment methods: We accept credit/debit cards (Visa, Mastercard, American Express), e-wallets (Skrill, Neteller, PayPal), bank transfers, and select cryptocurrencies. Not all payment methods are available in all jurisdictions.
• Deposit verification: All deposits are subject to verification. We may require proof of identity or ownership of payment methods before processing large deposits or any withdrawals.
• Third-party deposits: Deposits must come from payment methods registered in your name. Deposits from joint accounts require documentation proving your ownership interest. Third-party deposits are strictly prohibited.
• Processing time: Most deposits are credited instantly. However, bank transfers and certain cryptocurrency transactions may take 1-3 business days to process.
• Deposit fees: We do not charge fees for deposits. However, your payment provider may impose transaction fees for which you are solely responsible.

4.2 Withdrawals

• Minimum withdrawal: The minimum withdrawal amount is $20 USD or equivalent. Amounts below this threshold will be returned to your account balance.
• Maximum withdrawal: The maximum withdrawal per transaction is $5,000 USD, unless you are a verified VIP member with higher limits. Multiple withdrawal requests may be processed as separate transactions.
• Withdrawal verification: Before processing your first withdrawal (and periodically thereafter), we require KYC verification including government-issued ID, proof of address (utility bill or bank statement dated within 90 days), and proof of payment method ownership.
• Processing time: Withdrawal requests are reviewed within 24-48 hours. After approval, e-wallet withdrawals take 1-2 business days, card withdrawals take 3-5 business days, and bank transfers take 5-7 business days.
• Withdrawal fees: Your first withdrawal each month is free. Subsequent withdrawals incur a 2.5% processing fee (minimum $2.50, maximum $25). Your bank or e-wallet provider may impose additional fees.
• Playthrough requirements: All deposits must be wagered at least once before withdrawal. Bonuses are subject to separate wagering requirements detailed in Section 6.
• Closed accounts: If your account is closed due to violation of these Terms, all pending withdrawals will be cancelled and funds may be forfeited at our discretion.

5. Game Rules and Fair Play

All games on our Platform are governed by specific rules that you agree to by participating. General principles include:

• Random Number Generators (RNG): All casino games use certified RNG software that has been tested and approved by independent third-party auditors including eCOGRA, iTech Labs, and GLI. RNG certificates are available upon request.
• Game outcomes: All game outcomes are final and binding. In the event of a software malfunction or display error, all affected bets may be voided, and funds returned to your account balance.
• Sports betting: All sports bets are settled based on official results published by the governing sports body. We reserve the right to void bets placed after an event has started or where the outcome is already known.
• Live dealer games: Live dealer game outcomes are determined by physical cards, wheels, or dice in our licensed studios. Video recordings of gameplay are retained for 30 days for dispute resolution purposes.
• Maximum bet limits: Individual game maximum bet limits apply as displayed in each game's information section. Exceeding these limits through multiple simultaneous bets or "bet spreading" is prohibited.
• Maximum payout: The maximum payout per single bet is $50,000 USD for slots, $25,000 for table games, and $100,000 for sports betting (unless higher limits are specified in specific game rules).
• Disconnection policy: If you are disconnected during gameplay, your current hand or round will be completed automatically according to standard game rules. You may review completed rounds upon reconnection.

6. Bonuses and Promotions

All bonuses, promotions, and special offers are subject to specific terms in addition to these general rules:

• One bonus per person, address, IP, device, and payment method: Households, families, and shared networks may only claim one bonus collectively.
• Wagering requirements: Most bonuses require you to wager the bonus amount 35x (or as specified in promotion terms) before withdrawing any winnings derived from the bonus. For deposit match bonuses, wagering requirements typically apply to both deposit and bonus amounts.
• Game contributions: Different games contribute differently to wagering requirements: Slots (100%), Table games (10-20%), Video poker (10-50%), Live dealer (5-10%), Baccarat (10%), Blackjack (5%). Check specific promotion terms for exact contributions.
• Maximum bet with active bonus: While a bonus is active and wagering requirements are incomplete, your maximum bet per spin/hand is $5 USD (or equivalent). Exceeding this limit may void your bonus and associated winnings.
• Bonus expiry: Bonuses expire 30 days after being credited unless otherwise stated. Expired bonuses and associated winnings will be removed from your account.
• Non-cashable bonuses: Most bonuses are non-withdrawable. Only winnings generated from bonus play can be withdrawn after meeting wagering requirements. The bonus amount itself is removed upon withdrawal.
• Bonus abuse: Any pattern of play designed solely to clear wagering requirements with minimal risk (including "low risk betting," "betting on both outcomes," or "edge-sorting") constitutes bonus abuse and may result in bonus forfeiture, winnings confiscation, and account closure.

7. Account Closure and Self-Exclusion

We offer multiple options for account closure and self-exclusion to support responsible gambling:

7.1 Self-Exclusion (Responsible Gambling Tool)

• Temporary self-exclusion (cooling-off): 24 hours to 6 weeks. During this period, you cannot log in, deposit, or play. All pending bets are cancelled, and funds are returned to your balance. You will be automatically reinstated after the period ends.
• Long-term self-exclusion: 6 months to 5 years. During this period, your account is completely inaccessible. You will not receive marketing communications. You must contact support to reinstate your account after the exclusion period ends, subject to a 7-day cooling-off period before reinstatement.
• Permanent self-exclusion: Indefinite account closure with no option for reinstatement. You will be permanently barred from opening any future account with earthbetz.org using any identity or payment method.

To request self-exclusion, log into your account, navigate to Responsible Gambling settings, or contact our support team. Self-exclusion requests are processed immediately and cannot be reversed during the exclusion period.

7.2 Voluntary Account Closure

You may close your account at any time by contacting support. If you close your account voluntarily (not for self-exclusion), any remaining balance will be returned to you after verifying your identity, subject to any pending wagering requirements. Closed accounts can be reopened by contacting support within 30 days of closure.

7.3 Involuntary Account Closure (Suspension/Ban)

We reserve the right to suspend or permanently close your account without prior notice if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to our Platform or other users. In such cases:

• Your account will be frozen pending investigation.
• All pending withdrawals will be cancelled.
• Funds may be forfeited at our discretion, especially in cases of fraud, chargebacks, or money laundering.
• We may report violations to relevant authorities, including gaming commissions, law enforcement, and financial crime agencies.
• You are permanently banned from creating future accounts with earthbetz.org.

8. Intellectual Property

All content on our Platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, software, code, and design elements, is the exclusive property of earthbetz.org or our licensors and is protected by international copyright, trademark, and intellectual property laws.

You may not:

• Copy, reproduce, distribute, modify, or create derivative works of any content without our express written permission.
• Use our trademarks, logos, or branding without explicit authorization.
• Frame or embed our website content within another website without permission.
• Remove any copyright, trademark, or proprietary notices from our content.

We grant you a limited, non-exclusive, non-transferable license to access and use our Platform for personal, non-commercial gambling entertainment purposes only. This license may be revoked at any time for any reason.

9. Limitation of Liability

To the maximum extent permitted by law, earthbetz.org and its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our Platform.
• Any conduct or content of any third party on our Platform.
• Any content obtained from our Platform.
• Unauthorized access, use, or alteration of your transmissions or content.
• Technical failures, including server downtime, internet outages, power failures, or acts of God.
• Losses resulting from gambling activities, including but not limited to financial losses, regardless of whether we were advised of the possibility of such damages.

Our total aggregate liability to you for any and all claims arising from your use of our Platform shall not exceed the total amount you have deposited into your account during the 12-month period preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. Therefore, some of the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

10. Disclaimer of Warranties

Your use of our Platform is at your sole risk. The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express, implied, or statutory, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• Warranties that our Platform will be uninterrupted, timely, secure, or error-free.
• Warranties that results obtained from using our Platform will be accurate, reliable, or profitable.
• Warranties that any errors in our software will be corrected.

No advice or information, whether oral or written, obtained by you from us or through our Platform shall create any warranty not expressly stated in these Terms.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of Curacao, without regard to its conflict of law provisions. Our Platform operates under a Curacao eGaming license (License No. 1668/JAZ). The failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

11.2 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Curacao. The arbitration shall be conducted by a single arbitrator in accordance with the rules of the Curacao Arbitration Association. The language of arbitration shall be English.

You agree that any arbitration shall be conducted on an individual basis only. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not permitted. You waive any right to participate in a class action lawsuit or class-wide arbitration.

11.3 Limitation on Claims

Any claim arising out of or related to these Terms or your use of our Platform must be filed within one (1) year after the claim arose; otherwise, the claim is permanently barred.

12. Indemnification

You agree to defend, indemnify, and hold harmless earthbetz.org and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debts, and expenses (including but not limited to attorney's fees) arising from:

• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
• Your use of our Platform.
• Any claim that your content caused damage to a third party.
• Any taxes or fees you fail to pay related to your gambling winnings.

This indemnification obligation will survive the termination of these Terms and your use of our Platform.

13. Tax Obligations

You are solely responsible for reporting and paying any and all taxes, levies, duties, or other governmental charges applicable to your gambling winnings under the laws of your jurisdiction. We do not provide tax advice, and you should consult with a qualified tax professional regarding your obligations. In some jurisdictions, we may be required to withhold taxes from your winnings and report them to tax authorities. You authorize us to do so where required by law.

14. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, pandemics, epidemics, quarantines, labor shortages, transportation shortages, fuel shortages, energy shortages, utility or communication failures, cyberattacks, or governmental actions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy and Responsible Gambling Policy, constitute the entire agreement between you and earthbetz.org regarding your use of our Platform and supersede all prior agreements and understandings, whether written or oral, relating to such subject matter.
